Welcome everyone.

I would like to ask whether my case will stand the scrutiny at the Home Office.

I have moved to UK in 2006, however with accordance of Treaty Rights it requires only 5 years data therefore I decided to disclose last 5 years of my presence in UK;

4 January 2008 - 25 March 2009 Employed until receiving redundancy of around £10k
25 March 2009 - 9 June 2009 Unemployed (not claiming JSA due to redundancy - also not privately insured, however actively seeking employment)
9 June 2009 - 21 September 2009 Employed
26 October 2009 - 2 February 2010 (JSA - 4 months)
12 February 2010 - 14 February 2010 (2 day contract only - officially employed)
14 February 2010 - 21 April 2010 (Unemployed and not registered with JSA)
21 April 2010 - 13 August 2010 Employed
27 August 2010 - 27 September 2010 (JSA - 1 month)
28 September 2010 - until present Full-Time University Student (4 year degree with placement 2012 sept - 2013 sept where I have been employed in a Full-Time manner).

I also have been studying in part-time mode from September 2009 - June 2010.
I have fully comprehensive health/life care insurance from January 2012 - until present (continuing).


Can anyone advise whether I have fulfilled Treaty Rights. I know that there are 2 disconcerting periods in my history, namely time when I was unemployed and not registered as job seeker, however logically, I have become an employee after certain time (I was registered with employment agencies at the time).

I would like to become Permanent Resident, therefore I'm asking some of you (competent individuals in the subject) whether my history provides solid case for permanent residence.

Have you read through directive 2004/38/ec? Do you comply with its terms?

There may be a number of problems that a decision make might pick on. Having or not having permanent residence is not likely to inconvenience you greatly.

Cant seem to see much issue with those breaks in employment. Provided you explain it properly, you would be considered to have resided in accordance with the regulation during those period.

Thank you for your input everyone. I was suggested by a solicitor that period of unemployment should be explained in a "witness statement" i.e. me as a witness stating I have been actively seeking employment (which is true), by providing at which employment agency I was registered. It seems reasonable but I'm wondering if I can provide such explanation myself (in addition to my application) and whether it will be good justification?

Thank you for your input, however taking into consideration media and politics row about "how allegedly deteriorating foreign presence is within the borders of UK - surprisingly foreign investment in UK is desirable - little paradox" - I'm getting worried and therefore need further security, once I will move towards my MSc degree and subsequently Phd.

When you said "problems decision make can pick on", could you be more specific please?

PS. I also see another issue, for period of September 2010 - January 2012 (during University) I was not privately insured - PR application states person supporting application on University ground, is required to have comprehensive medical insurance.
