Applying for ILR - From Tier 2 General

Post by ashleyransoo » Wed Jan 15, 2014 2:31 pm

Hi Everyone,

I need some help working out the duration counting towards IRL.

I understand that if you are on Tie 2 general then, you need to be on the category for 5 years to be eligible.

I was previously on post- study work which ended in September 2010.

I then applied for a Tier 2 General work permit. This was only granted to be in February 2011 as my application was refused and had to go through tribunal which was won.

I was then granted from February 2011 to September 2013. September 13 was set on my application but start date was meant to be from September 2010.

I have now extended my Tie 2 General visa and has been granted for 2 more years which has an end date of September 2015.

I am assuming that frmo September 2015 I should be eligible for ILR. But I am not quite sure how are they going to count the period between September 2010 and February 2011 when my application was with them and tribunal case was in progress.

Can someone please enlighten me.

Summary Info:

September 2008 to September 2010 - Post Study Work
September 2010 - Application for Tier 2 General sent
September 2010 to February 2011- Application with Home Office
February 2011to September 2013 - Tier 2 General Granted
September 2013 to September 2015 - Extended Tier 2 General

Many thanks and looking forward to hear you,
Ashley.

Hi,

Does anyone have any suggestions regarding my query?

Would really appreciate an answer from the moderators.

Or if anyone could suggest me a good solicitor please.

Thanks,
Ashley.

T2 was granted in Feb2011 so you will be eligible in Feb2016

Thanks Manka.

Si does that mean I would have to extend again in Sept 2015 for further 5 months?

Also, is it possible for my employer to request for my current tier 2 to be extended to a further 5 months to cover the 5 years period as they have wrongly calculated the end date?

Many thanks.
Ashley.
