Request For your help: ILR Application: Can I go for it.

Post by Desperate_immigrant » Thu Jan 23, 2014 1:15 pm

MY Dear Forum Mates,

After talking to couple of legal advisers, I am yet to get a clear answer on my case and hence as last resort came here to seek your valuable feedback and help.

First Entry to UK: 16 OCT 2008 ( 10 months after first Visa)
First Extension: Jan 2010
Secondy Extension: Jan 2013
Valid validity: Jan 2015
1- My First Question is about my days outside UK. I went to Work outside UK in March 2010 as I didnt have job here. However, I remained self employed with HRMC and payed NI from March 2009 to 2012 March. Even my first extension was done on self employed basis. Please look at the summary below and advice on my position whether should I take risk and apply for ILR

Year Depart Arrive Days Absent
2008 09/12/08 31/12/08 22
2009 01/01/09-26/01/09 =25
2010 13/03/10-23/07/10 =132
2010 08/08/10-31/12/10 =145
total in 2010 = 277
2011 17/01/11-08/09/11 234
2011 27/09/11-08/12/11 72
total in 2011 = 306
2012 13/02/12-14/03/12 30
2013 05/03/13-23/03/13 18

As you can see in 2011, i even spent 8 months continiously outside UK.

2- my second Questions is whether Home office will check the Tax records of last 5 years throughout once I ll go for ILR?

Appreciate your help in this regard.

More than 6 months outside UK (unless compassionate) breaks continuous residence, also you have gone way over the limit of 540 absences in 10 years

HO can check any records including tax history

Thank You Manka..appreciate your response.

Would this mean that I have to wait until 2017 to get my ILR as since 2012, I have not been out of UK more than 20-25 days in total. So this is how I will spend 5 years continuously in UK. Any other route/chance ?
