TIER 2 (ESV) to ILR

Hi All

Really hoping someone can help me with this...

I am posting on behalf of my husband, I am a British Citizen, he is a New Zealander. He has been in the UK for almost 5 years on a Tier 2 employer sponsored visa (his visa runs out on March 14th). Since he has been here we have married. He has been in the same job with the same company since he has been here and intends to stay doing the same job for the same company (they are going to write him a letter to go with his application to confirm this).

Our questions are:

1) We are going to apply for ILR using the form SET (O) is this correct?
2) When he came here he remembers having his biometrics done (in Auckland) but he has no proof of this and doesn't have the receipt or anything, would he need to have this done again before we apply or do you apply and then get them done? Can anyone advise of the costs?
3) As he's from an English speaking country we gather he doesn't have to complete a 'Life in the UK' test, please can someone confirm?
4) Lastly we are thinking of paying the extra and going to our local office (Cardiff) to get this processed in person. Does anyone have any pointers about doing it this way? Would you recommend it?

1. set o forms yes
2. biometrics will be re-done at PEO or post office
3. he needs to take the life in the uk test unless he is more than 65years or under 18 years. because he is from an English speaking country, he doesn't need to show English language ability; the two are not the same.
4. So longer as you can pay for PEO, no problem, but still have to book appointment online even if you live in Cardiff.

Great - thanks for the reply. Can you advise where he can take the 'Life in the UK ' test, how do we go about booking this? Also do you know how much it costs? Should we get this done before we make the appointment at the office?

It's set O forms if he wants to apply for ILR based on 5 years on tier 2 general
And set M forms if he is your dependant and applying for ILR as a spouse of a british citizen. From your post I didn't get the impression he's on a dependant visa. If he is then Manci is right in saying set M forms.

Thanks - no he's not on a dependent visa and is applying in his own right from being in the UK 5 years on an employer sponsored tier 2 visa.

We will write in the supporting statement that he is married to a UK citizen and that we have been together 4 years. Should we include cohab docs? If so what type of things should we present?
