Tier 2 Application after visa expiry

Hi,

I have a few questions in regards to visa application within 28 days of expiry of previous visa.

- Is it possible to apply for a tier 2 general from psw visa within 28 days of its expiry. If yes, would it have any implications on the application. Will I have to send a letter explaining why i did not apply when leave was valid ?

- If the application is rejected, would my stay be considered as unlawful ? and will it have impact on 10 year ILR ? Also, will it effect my new application from outside the country ?
