Applying ILR for wife..

Applying ILR for wife..

Hi Everyone,

I' am a British Citizen and my wife she is on a dependent visa, she applied for visa before July 2012 rule but visa got issued in Aug 2012 .. the visa was issued for 2.5 years.
Can she apply for ILR after 2 years .. or just an extension for 2.5 years then apply for ILR.
Any help will be much appreciated

Was this leave issued from outside the UK? Was it for 27 months?

Thanks for the reply, yes It was issued outside UK in India and it's for 27 months..

Then she may apply for ILR up to 28 days prior to the completion in the UK of her 2 years qualifying period.

Hi shakmo",
For the fact that she was granted her visa in August 2012 puts her in another extension of 2.5 years before ILR as she is now under the new rule.

Hi Guys,

Thanks for your replies, I' am getting mixed information.. The HO website says if you made the application before 8th July 2012 then you are eligible for old rules..

Visa issued in India
Also can anyone tell me for how long can she stay out of U.K before applying for ILR as dependent

Vinny has given you the correct information. The application was submitted under the old rules. Spatacus is incorrect.

Absences should be limited and for good reason. Only absences of 6 months or more are requested on SET(M).
