Naturalisation for baby with ILE visa

Hi,

My husband got his ILR in March 2013. I got my ILR in Jan 2014. My daughter got her ILE from India by August 2103.

1. My husband is eligible for naturalization by March 2014. Can my daughter apply for her naturalization along with my husbands application or she need to wait for an year from the date she got her ILE? Please clarify?

2. Also to apply for my naturalization i need to be 1 year after ILR and is there any other rule like 90 days i should not been out of UK. Please clarify?

I don't think your daughter has to wait a year - she can apply with your husband.

You can apply as soon as your husband is naturalized as a British citizen (if you meet the requirements) as a spouse of a British citizen. If you apply as a spouse of a British citizen, you do not need to hold ILR for a year. Regardless of if you apply under 5 year residency or spouse of a British citizen (with 3 year residency), there is the residency requirement that you cannot be outside the UK for more than 90 days in the preceding 12 months from application. However, there is discretion that can be applied for, and if granted, the discretion can be for absences for up to 179 days. See page 8 http://www.ukba.homeoffice.gov.uk/sitec ... let_an.pdf
