Tier2 ICT (Established Staff) -> Tier2 General -> ILR

Post by Master81 » Sun Feb 09, 2014 3:57 pm

Hi,

I had Tier-2 ICT Established Staff visa on 01 April 2011 (before 06 April 2011 new rules) for 3 years ending on May-2014 and entered in UK on Aug-2011.
Then I changed my employer in Mar-2013 from Tier-2 ICT to Tier-2 General and got visa for 1 year with the same ending date as my previous Tier-2 ICT which is May-2014.
Due to issue with my previous employer sponsor license I joined other employer in Sep-2013 (same tier-2 general category) and got visa for three years which is ending in oct-2016.

So following is total times i spent in UK with my previous employers and time going to spent with my current employer
Employer1 - Tier2 ICT Established staff - From Aug 2011 to Feb 2013 (Around 1 year 7 months)
Employer2 - Tier2 General - From Mar 2013 to Aug 2013 (Around 6 months)
Current Employer3 - Tier2 General - From Sep 2013 to Oct-2016 (Around 3 years)

1. While applying for ILR does my Tier2 ICT times will be considered toward continue 5 years ?
2. If not then Is there any possibility to get Tier2 General visa(expiring on Oct 2016) extension and how much extension I will get ?

Thanks for your time and supports.

Your time under T2 ICT Establish Staff doesn't count for the 5 year qualifying period. You will be eligible for ILR in March 18 if you stay on T2G (minimum salary £35k).

In Oct 16 you can apply for a 3 year extension provided your sponsor wants to continue employing you for a further 3 years.

Hi Manci,

Thanks you very much for your reply.
Regarding minimum salary requirement £35000, Is there any time duration or years I need to have this salary ?
Or while applying for ILR, UKBA will look only what given salary in CoS ?.
Is there any way to change salary after getting CoS ? If new CoS requires to change salary requirement do i need to go through the same process again, starting from filling up everything and applying to UKBA ?

it is only at the time when you apply for ILR that your salary will need to be at least £35k (or the appropriate rate for your SOC code, if that is higher). Read pages 4-5:
