Late Entry in UK on Tier 1 General Visa

Post by mak2014 » Mon Feb 10, 2014 4:27 pm

Dear Sir/Madam

I got Tier 1 General visa on 7th May 2009 for 3 years (Valid untill may 7 2012)and entered UK on 30th October 2009 (after 173 Days). My extension was issued on 17th May 2012 for two years and valid till May 17 2014. After my first entry I have just two visits out side uk one for 25 days and one for 75 days. My question is will I apply for ILR in may 2014 or I need to apply for extension for my missing 75 days.

Thanks for referring FAQ Q17 but my question is still unanswered or I am not clear. Can somebody confirm which application I need to file in May 2014 ILR or FLR

Question 3 in the link provided by vin123 explains the different scenarios one may encounter in considering the qualifying period. You cannot apply for ILR in May 2014 as you have not been in the UK continuously for five years. You therefore need to apply for another extension. I believe you will be eligible for ILR 28 days before the fifth anniversary of your entering the UK as you entered the UK after 90 days of your initial grant-date.

Thank you very much both of you. Now I believe I should go for another extension in may 2014...regards
