Can I Switch to Tier 2 while my tier 1 Ent appeal is pending

Can I Switch to Tier 2 while my tier 1 Ent appeal is pending

Hi.
My Tier 1 - Entrepreneur Visa has been rejected and I have already submitted an appeal against my decision. I applied from a Tier 4 General Student Visa to Tier 1- Entrepreneur. I would like to know if I can put in an application for Tier 2 visa while my appeal is under progress. For your information my Tier 4 General student visa expired on January 2013.
