90 Day Concession Period(Absence Calculation):

Post by chandu_246 » Sun Feb 16, 2014 2:19 pm

Hi All,

This forum has been great help and I have a question on 90 day continuous period.

TIER1 Valid from : 1st June 2009

Uk Entry Date : 29th Aug 2009

Delay in entering Uk : 89 Days

1. Is my calculation correct?

2.As I have entered UK on 90th day,my understanding is that I didn't break 90 day concession rule and I am eligible for ILR. Is that right?

Rule : The period between entry clearance being issued and the applicant entering the UK may be counted toward the qualifying period, as long as it does not exceed 90 days. This can occur if the applicant is delayed travelling to the UK. The period of delay will not be counted as an absence if it does not exceed 90 days. If the delay is more than 90 days, none of the period between entry clearance being issued and the applicant entering the UK can be included in the continuous period calculation.

Regards,
Chandra

You should be fine.

A friend of mine applied with 93 days at one of the PEO and he was granted ILR.

So far as it's 90 days or less it's acceptable.
