Registration for Child born & living in India

Hi,

Myself and my wife got our ILR in Jan 2013 and are eligible for British citizenship from Jan 2014. we are currently residing in UK.
We have a child who is born in India on April 2013 and she is living there since birth with her grand parents. She has never been to UK and has no Indian passport yet.
Can we apply for her registration(MN1 form) as British Citizenship along with us ?
If not what is the best possible way to get her to UK?
Please advise.

no you cant as child was born outside the uk and would need ILR for citizenship application.

you will need to apply for a settlement child entry clearance visa

Does this mean,
1. We need to apply for her Indian passport
2. Once she gets this then apply for settlement child entry clearnace visa?

If so, which form is this?Do we have to apply for her settlement visa from India or UK?

Does the process change if we apply for our naturalisation first?

Does the process change if we apply for our naturalisation first? No change as the visa is for child of person settled (ILR) or British Citizen.

Further to my previous post,
My husband who is the main applicant has been out of country for a total of 90 days in 5 year period.
Myself, I have been out for 330 days in last 5 years
and in the last 12 months I have been out of country for 92 days. I have seen that the maximum no.of days to be out of country in the last 12 months is 90 days. Does this only my husband is eligible for British Citizenship? Am I eligible to apply along with him?

Absences are calculated backwards from the date of application received by UKBA for naturalisation and is based on the 5 years immediately prior to that date. So for if you are applying now and you both meet the 5 years residence requirement individually (AN applications means each , you will be fine with 92 days in the last 12 months as absences of about 100 days are ok and 330 days is well below the 450 maximum for 5 years residence..

Have you been resident for a full 5 years?

Yes, I have been a resident through out the 5 years with a total number of absences of 300 days in last 5 years adn 92 days in last 12 months.
So based on this, I am eligible to submit along with my husband' application?

Yes and you can then benefit from the spouse joint fee but completing separate AN applications.

Thanks a lot for the information.It was very helpful. Will apply for both of us using separate AN forms .
For child - will apply for her indian passport and get her child settlement visa.
One last question - regarding indian passport for child born & residing in India, can we apply for this from UK, i mean HCI London?
