ILR and dependancy visa

Hi again

I was wondering in regards to the ILR, the salary requirement based on the current rules is £35,000 p.a.

Is the salary requirement based on:
1. the average of salary over the five years of continuous stay
2. Employment contract upon applying for ILR
3. Employee's salary in the final year?

I am also in a relationship with my girlfriend who is from Hungary. I was wondering whether it might even be worth while to apply for dependancy visa, however, I am not sure how the dependancy visa works in regards to people from the EU
