Student to Tier 1

Hi All,

The enquiry is regarding a friend of mine.

He came to the UK in 2011 on student visa for diploma.

The diploma is ending in April 2014 and his visa is ending August 2014.

He is a professional chef and is offered a Tier 1 sponsor visa from a big restaurant chain in Scotland.

Is he allowed to take the offer and switch his visa category from Student to Tier 1 through this company?

If yes, can he apply with in the UK or need to go back and apply from his home country?

Apologies for the confusion.

I meant to say the Sponsor visa. I think it is Tier 2.

Can you please tell me if this is allowed.

By looking at the UKBA website, they say that if the job is offered in Scotland then it must be SCQF level 9 or above.

If you want to offer someone a skilled job, it must be Scottish Credit and Qualifications Framework (SCQF) level 9 or above for both Tier 2 (General) and Intra-Company Transfer.''

but when you go on to the link they have provided for SCQF, it is not very clear that what kinds of jobs are on each level.

Do you have any information of how the 'chef' can be considered as per SCQF level
