URGENT: NEW APPLICATION UNDER 3C

My appeal to First Tribunal was dismissed on 28-Feb-14.... I am putting a new application for Tier 1( Ent) Visa.

I have a serious concern. As per my understanding Section 3C applies on me for 5 working days.

Should I first apply for Permission to appeal to upper tribunal and then put my fresh application and then withdraw my appeal to upper tribunal

or can i directly apply for a new application within these 5 working days..

You have 5 working days to lodge your appeal to Upper tribunal and 28 days to make a fresh application but bear in mind if you go for fresh application and its not successful then you wont get right of appeal.
So I would suggest you to go for UT and try your luck there. If your appeal at UT isnt successful then you still can make fresh application with in 28 days.
