ILR Spouse(dependent) and claiming Benefit

Post by dan134 » Fri Mar 14, 2014 12:00 am

Hello
can anyone help me
1. I and my two kids are British passport holder and claiming child tax credit and child benefit,
My wife is on ILR dependent visa granted on April 2012 in India and expires July 2014 as per my knowledge it doesn't effect her ILR
but on child tax credit letter from HMRC appears both of us names ( on her visa says " No Recourse to public funds") does it effects her ILR
2. Do i need to show maintenance funds for last 3 months, if it is how much i have to maintain for couple & two kids
the only problem is i earn £1525 per month net ( £365 child tax credit and £134 child benefit) after paying all bills, rent, council tax and personnel expenses balance will be £300 to £400 end of the month

3. She came to UK in September 2012 ( Visa issued from 10th April 2012 to 10/07/2014), according rules 28 days before i have apply which is 10/08/2014, if i apply before 10/07/2014 by post do UKBA refused her application

Regards
Dan

1-2, no, 3, apply by post for an extension, at the end, before leave expires, then vary to SET(M) when eligible.

Thanks for reply amber
do you want me to apply SET(M) before 10 July and apply for SET(O) while they processing SET(M) in that case i have to pay twice
i forget to mention
my wife was on student visa in Feb 2009 and we married in September 2009 registered in UK with UKBA permission (COA) and she went back to India Feb 2010 then
She came to UK in September 2012 as ILR dependent visa (issued from 10th April 2012 to 10/07/2014), according rules 28 days before i have to apply which is 10/08/2014, but her ILR dependent visa expires on 10th July 2014
Does her previous duration when she was on student 2009 will be consider under 2 year probationary visa
which she is short of 1 month

Thanks
Dan

Apply for FLR(M) then vary (paying any additional fee) to SET(M) when eligible. B1 English and LIUK required for settlement.

Old rules, if you're working full time, no issue.
