Hello, Month ago I applied to get permanent resident status. I have already temporary resident status(Blue book). They refused because how they said previouse employers didn't registered me in WRS. I am Polish and I am working here from Sep 2007 with no breaks, I have all contracts, P60, payslips. However 3 of my previous employers didn't do registration. From 1 May 2011 Polish employee don't have to be registered on WRs.
Can I do something in this situation? I have been registered only by first employer in 2007 .

Hi...

A Polish worker who is required to register with the WRS must register their employment within one month of starting work for that employer. Registration ceases when they stop working for that employer and if and when they start working for a new employer they must register that new employment with the WRS.

A Polish worker who has worked legally in continued registered employment for 12 months or more without interruption (i.e. periods of unemployment must not total more than 30 days in any 12 month period) is entitled to full free movement rights and is no longer required to register.

was it less then 12 months in your 1st job and after that you didn't register right?

Well in that case your 5 years count from 01/05/2011 So you can apply for PR in 01/05/2016

UKBA is right to refuse you then.

In simple terms if you registered with first employer and stayed with that employer for at least 1 year then it wasn't necessary to register with other employers at all.

OK, but what if you applied for wrs but a bit later than in 1 month?? they will refuse your PR too?

I don't think so, it could had been s subject to fines if you failed to register.But mind it, based on experience of many people 'refusal' does not necessarily mean justice done.

So what do you want say? I have every wrs, but few of them were applied later than 1 month from start my work. They can charge me for that?
I was looking for someone else experiences but didn't find anything related with wrs and late applying + applying for PR. I probably will give a try and I will see.

first WRS you can apply anytime ( they never fined anyone )

You can register even after 6/7 months working in the UK but your legal work for PR / Right to Reside / British Citizenship will count from the date you register / date you send WRS application


But your case is different. You can apply and see . it doesn't cost much £55

Yeah, i will do it anyway.
I am quite confused form that dates, because then I have big gaps between jobs. When I started work in first job from 1.06 but WRS was issued 20.8 and then next job started 1.3 and wrs issued 27.4 means i am that almost 2 months withour legal work? How that affect my application?

By EEA LAW you should be refused PR or Citizenship but you can try May be you will be lucky no problem in applying PR first.

BC is expensive if you loose

I am afraid the legal work for PR status counts from the date your WRS application is issued. Same happened to my spouse and PR was rejected last September because WRS was issued/approved in April 2009 even though the work started with the employer from 2008 and applied for WRS January of february 2009(cant remember). Consequently, was told to re-apply for PR after April 2014.
