Tire 2-Tire 1- ILR

Hi,
I have couple of questions regarding my ILR eligibility and First date of entry.
On 10th Dec 2008 came to UK on Business Visa and 15th March went back to India. I came back to UK on 30th April 2009 on Tire 2 ICT Visa and in May 2011 switch over to Tire 1 General . Current Tire 1 visa is valid until May 2016.
Here are my questions,

an I apply my ILR on 3rd or 4th April, as I read on this forum that we can apply before 28th days of qualifying date and also home office is going to increase the fees on 6th April 2014.

What date I should mention on my application form as first entry date in UK? 10th Dec 2008 or 30th April 2009
