Resident labour market test april 2014 application for RCoS

Hi Guys,

I have a quick question with following facts:
1. We want to apply for a restricted CoS on 8 April 2014
2. Resident labour market test was completed on 20 March 2014
3. Salary indicated in the advertisement was 500£ less than the applicable salary for the job under new rules coming into effect from 6 April 2014
5. We were not aware of the new salary coming into effect in April 2014
4. We are ready to pay the minimum required salary that corresponds to the job code.

Now the questions are:
1. Will that difference of £500 make a difference while applying for restricted RoC?
2. When/at what stage will the resident labour market test be considered to have passed by the sponsor?

Any response will be highly appreciated.

There was a similar situation in April 13 when some of the rates of pay changed. For the transitional arrangements at that time see paras 26.7 - 26.8 in the T2 sponsor guidance:

New guidance is going to be published after 6 April 14. May be the transitional arrangements will be similar but one has to wait and see.
2.
With the application for an RCoS details of the RLMT have to be provided and the HO may check these.
