Visa Appeal won - whats next?

Post by bes » Fri Apr 04, 2014 2:00 pm

HI
Can someone please advice on my case.

I applied for Spouse visa, wich was refused, then I appealed via tribunal and the decision was overturned by tribunal judge, (this was in 24Jan 2014)

I called the Tribunal and they told me the Home office had 5 days to challenge their decision or otherwise we will get the visa,

rang home office few days ago they said I have to speak to the embassy,
embassy say they have not received anything from home office,
I keep going around the houses and not sure whats the next step

I'll appreciate any advice that you can offer

Same situation with my niece. Tribunal inform us the judge rule in your favour, which mean we won the case. We got excited and happy. We also being told that they have 10 days if they wish to appeal...ten days passed...so waited for all documents to be proceed from tribunal to HO and then embassy...

but this waiting goes on and on, and now after more than 12 weeks, HO send a letter to her lawyer which says that you won the case on Art 8 but lost on financial requirement. And HO currently ordered ON HOLD all the cases until another on going case in court decided.

No, we couldn't, and it was extremely frustrated situation :x ....our MP did help us to write letter to HO...then HO office inform us that your case is ON HOLD.

Our lawyer said it is wrong for Home Office to hold our case even though tribunal passed a judgment....but nowadays HO do whatever they want regardless of what wrong and right either legally or morally.

right..on my case Home Office don't even acknowledge they have received any letters from Tribunal Judge, nobody seems to take any owernship and its been going for over 12weeks.

Do you think by taking a solicitor will help anything?
