FLR m or SET m

Post by rehan78 » Sun Apr 06, 2014 10:40 am

hi gurus,
i got my ILR on 10 years long residence basis in Jan 2014 and my wife is on Tier 1 dependent and she got visa till march 2015.
My wife joined me in july 2009 as a PBS (PSW) dependent.
My question is can she apply directly indefinite leave or she has to get first set m and then indefinite ?

Thankx
Rehan

You were told previously that your spouse needed to switch to FLR(M). Now you have left it too late, she will now be on a new 5 year route to settlement with a Financial Requirement (and English) once she switches to FLR(M). If you had applied yesterday (or before), she would have been able to switch to FLR(M) under Part 8 of the rules and in turn settled as soon as FLR(M) was granted, there would have been no Financial Requirement.
