Visa Type : Tier 1 (General) Migrant
Entry Clearance date: October 2008
Date first entered: July 2010
Returned to home country: August 2010
Entered UK again in: Dec 2010 and residing continuously since Dec 2010.
Can I apply for ILR in July 2015 considering continuous period as
July 2015 - July 2014
July 2014 - July 2013
July 2013 - July 2012
July 2012 - July 2011
July 2011 - July 2010
Between July 2010 - August 2010 (30 days)
I came on deputation on behalf of my employer using my Tier 1 Visa and salary paid in INR.
Did some jobs search and attended some interviews.
Return back on August 2010.
97 days away from country.
I got a permanent job and came to UK in December 2010.
Since then, I have renewed my Visa twice (Oct 2011 and Oct 2013)
Planning to be away from country for 22 days between July 2015 and July 2014 on annual leave.
Things to know.
Considering my First entry date am I eligible to apply for ILR on July 2015 for my case?
If so do I need to claim points for earning for the complete 5 years?
UKBA ILR document says “You should be economically active” as a criteria for eligibility. What does that mean?
Is there any consequence for my 97 days of absence in getting the ILR?
Do I need to produce any documents for this?
It will be much appreciated if someone clarifies my queries.
Thanks in advance

So long as absences do not exceed 180 days for each 12 month period there should not be an issue.
