Tier 2 General switching to new sponsor with dependent wife

Post by hiphopshaker69 » Thu Apr 10, 2014 1:48 pm

Hi there,

I got my current Tier 2 General back in July 2013 (applied within the UK and switched from Post-Study Work VISA) and my wife got a dependent VISA in September 2013 (applied from India).

I want to apply for a new Tier 2 because I want to work for another company and that company is ready to sponsor me.

I just wanted to know the following:
  • Is there any cooling-off period applicable in this case?

Does my wife need to apply for a new Tier 2 as well if I apply one for myself? Can she?

    What's the process for this?

What are the costs implications here?

I applied my current work permit after a Post-Study Work VISA. Do I need to fulfil Resident Labor Market Test?

Any other notable things do I need to know about before making any decision?
Any help is appreciated.

Cheers

It's strange that no one replies here.

s there any cooling-off period applicable in this case?
No; hope you plan to apply this within the country

Does my wife need to apply for a new Tier 2 as well if I apply one for myself? Can she?
Yes; new dependent visa is required

What's the process for this?
You can apply within the country after receiving the new COS from the new sponsor

What are the costs implications here?
Cos cost / visa stamping cost(premium one day stamping) = ~1500GP

I applied my current work permit after a Post-Study Work VISA. Do I need to fulfil Resident Labor Market Test?
Yes; your new sponsor need to fulfil the resident labor market test.

Any other notable things do I need to know about before making any decision?
Dont resign the existing job before switching to the new sponsor; as you never know the outcome

Perfect answer but if your new job under shortage Occupation List than you don't need Resident Labour Market Test.

Hello

I'm working with one of small farm based in London on Tier 2 General as a Sales Manger from last 1 year (Join date 1st May 2014) I completed my master from university.

Unfortunately my company license expired because of we didn’t get any mail from UKBA that license going to expire and management was outside country. Because of this issue I got 60 days letter from UKBA mention that please find another sponsor or leave country.

Meanwhile my management had words with UKBA for renew license for Tier 2 but unfortunately they said you can’t Renew it you must to reapply and management already proceed for reapply again. But I need few information please sorted out some queries about Resident Labour Market Test (RLMT)

My queries are like following

1. If license get back successfully do I need to reapply for Tier 2 with same sponsor (I got 60 days letter) and If yes than do I need Resident Labour Market Test (RLMT)..?

2. If I find another sponsor who have CoS already than for that how much wage I need to show also do I need Resident Labour Market Test (RLMT) in this case..?

3. Can I switch with Tier 2 General to Tier 1 Entrepreneur if yes than how much balance I need to require..?

Looking forward from you.

Thanking you,
Mehul Bhatt

I was in Tier-2 General Visa and recently i have changed my employment and got new Tier 2 Visa under my new employer CoS. My wife is with me in UK as dependent she has Visa valid until June 2016.

Whether my Wife needs to apply new Dependent Visa because i changed my employment and new tier-2 General Visa ?
