refused residence card for a family member of an EEA

Hi

me: german
wife: turkish

My wife's application has been refused because we have send only a photocopy of my passeport ( i dont know why we did that )

Now also her VISA runned out yesterday, can we still apply for her residence card and use the premium service or do we need to go another way ? first visa than residence card ?

And i guess, they really would need my passeport aswell .. or can we appeal against it ?

Reapply with the original documents as soon as possible.
There is no premium service for EEA2 applicants.

anyhow i registered and there is no option to choose EEA2

There definitely is no premium service for EEA2.

apply with original passport and nothing to worry about visa running out as family member of eu citizen even if visa runs out is not a big deal
You may have to fight a battle more than once to win it.

I was also refused on the grounds of calling my passport back (even though I sent it with the application, but then had to travel and called it back). They also told me that they didn't like the facts that I sent only bank statements and rental agreements as proof of address. So basically, they can refuse for any reason, bcoz of any even minor things. We have appealed and won the appeal. So you could try to do the same. Alternatively, you would need to get your wife a family member of EEA national short term visa (like 6 months - free of charge) and then reaply with all the documents this time round.
