you can apply when you get your passport back from HO and it wouldn't affect in the outcome of your application if it hadn't expired at the time of your application [in the normal case scenario]. so relax.

H iBeekay
did you contact HCI london and explain that ur passport was with HO. Because is saw today that

"If there is no Visa or Residence Permit, then a short validity Passport valid for two years would be issued if the applicant furnishes proof that his/her visa application is pending with the UK authorities or he/she has other options to regularize stay in UK. This short validity Passportcould be renewed on annual basis (maximum extension will be restricted to 3 years) till the Passport holder obtains a valid Visa or Residence Permit. A full validity Passport can be issued only after the Passport holder obtains valid Visa/Residence Permit." (ref: https://www.hcilondon.in/passport.html)

hope this may help u. as i was not aware of this before, i am really struggling now.
I received my passport (expired in march 2014) and BRP yesterday and I need to travel by this friday 16th may 2014.

it seems my 18 month wait for visa and that struggle is still contiuingggggg
