HELP NEEDED! PR Refused and first tribunal unsuccessful

i am a non EU citizen and married in 2006 with my EU partner and got RC in 2007 till 2012, i submitted papers july 2012 for PR but it refused because of my EU partner's 17th months absence, i appealed first tribunal it heared last month and judge agreed HO decision in law, i am not appealing for upper tribunal, i am getting divorce with my partner, whilst divorce prosess, am i in danger enforsment to country? pls anyone who has knowledge about this, give me a advise
