COA - Cannot confirm right to work

Hi, I hope you can help us. I submitted my 2nd application for a RC as my first was refused on the grounds of my sponsor was not exercising her treaty rights - had been a job seeker for longer then 6 months. The irony was that she was offered a position 2 days after the letter of refusal arrived. As our circumstances had changed we decided to re-apply.

We sent the following documents:
My Wife's passport
Our Marriage certificate
My wife's letter of employment and contract
Joint bank statements
Our lease
My South African drivers license

We could not send my passport as HO had this and was holding onto it until my appeal - in October.

I received my COA today which said they could not confirm my right to work for the following reason:
Current valid identity documents for yourself / your sponsor
evidence of relationship with EEA national sponsor
sufficient evidence of your sponsor exercising treaty rights

It also stated that "We will not revisit the terms of your Certificate of Application during the consideration of your case"

We are very confused by what they mean - we did not supply the correct documents as other than my passport (which they have) we did supply all the correct documents.

We thought about writing to them and asking what they mean and to confirm the documents that they do have but not sure if this is the best idea as they that said we should not write to them.

What would you suggest we do.

Although my wife is working she is on minimum wages and we cannot afford to live on her salary alone for 6 months while they make their decision.

Write back to them and ask for a corrected CoA.
Check the FAQ before posting!
Citizenship (adults, children, passport)
EEA (EEA FP, RC, PR, Surinder Singh)

Ireland RC: Granted Feb 14
Returned to the UK: Feb 14
Applied for EEA2: 18th March 14
EEA2 Rejected: October 14 (re-submitted docs)
EEA2 Granted: December 14 (valid till 2019!)

ii think its becoming a common practice now not to issue COA with right to work.
You may have to fight a battle more than once to win it.

It is indeed, but we should not give up. If you are in a committed (especially if married) relationship, they do not have the right to reject your rights to work. If you need to work, kick up a fuss! At least just write to them and say that you think they made a mistake. Don't worry...there's no negative impact.

I have put in a Freedom of Information Act request about this. I'm sure nothing will come of it any time soon though.

Hi,

Just thought I would let you know that I sent a letter requesting that they re-look my COA and send me a correct one on Thursday 8th May- they received it on Monday 12 May and on Saturday 17 May I received my new COA with right to work.

Thank you to everyone that suggested I send the letter. It is worth doing. We are very relieved and now hopeful that I get my RC soon.

My husband had the same problem. I also sent a letter to correct the COA and its been 7 weeks and I have not had any reply. After 4 weeks I had written to the deputy caseworker and she replied by email saying your enquiry on the 8th of april is being dealt with. Its the wrong date as well. She told me not to email email her again.

I dont know what else to do. Do you think they are deciding on the case itself? As its been 2 months since I applied.

I missed the mail man on Saturday so he left his calling card, so we had to wait till this morning to go and fetch the alleged “parcel” that had to be signed for. I wasn’t expecting anything, so I was unsure what it could be (hoping it was my RC and not another rejection letter). Well it was a looooooong weekend. Got the package this morning and it was my RC. We are so relieved that I have got it now.

congratulations and can you confirm your timeline ,when did you applied for RC AS home office is issuing rc in about 2 months from january.
You may have to fight a battle more than once to win it.

Hi ,

we have the same problem married couple got a COA with "unable to confirm the right to work" we have provided all the original documents (passports, marriage certificate, payslips and contracts). My husband is currently working as he had a doctorate extension visa with the right to work until december

Can you please advise what we should do where exactly did u send a letter to?

Hi,

We wrote to the address at the top of the COA - I think it was a Liverpool address.

We just said that we are confused as the have the docuemnts and listed what we had sent them and asked them to re-look my COA and send the correct one.
