Question on Eligibility

Hello,

I wondered if you could kindly help me, I wish to understand when I would be eligible to apply for ILR.

Granted Tier 1 (General) Migrant on 9th November 2009 valid until 9th November 2012.

Applied for extension before the 9th November 2012 and granted leave to remain under Tier 1 general until 16th January 2015.

Question is:
Do I need to wait till 16th Jan 2015 (or 28 days before) to apply for ILR or Do I need to wait till 9th November 2014 (or 28 days before)?


Further more I had applied in 2007 under HSMP, during the time of extension in 2009, my application got rejected due to maintenance funds criteria.

But I put in fresh application and was granted further leave to remain under Tier 1 (General) in 9th Nov 2009.

And hence I'm applying for ILR under Tier 1 (general) application that was granted on 9th Nov 2009, see history below.


- On 6th August 2007 granted Leave to remain in the UK as a Highly Skilled Migrant (HSMP) until 6th August 2009
- On 1st July 2009 Applied for extension of Leave to Remain under Tier 1 (General) under PBS
o Application rejected on 6th Aug 2009 - Maintenance funds criteria was not met
o Appealed on 14th Aug 2009 via Solicitors (Coventry)
o In addition to the appeal, solicitor contacts Home Office for reconsideration
o Home Office accepts if Appeal withdrawn
o Solicitor advices to withdraw appeal and ask's Home Office for reconsideration
o Home Office Reconsiders & Rejects on 29th Sept 2009
o Approached Immigration Advisory Service UK (Birmingham)
o Solicitor recommends to submit fresh application
o Submitted fresh application 19th Oct 2009

- On 9th November 2009 granted Leave to Remain in the UK under Tier 1(General) until 9th November 2012
- Applied for extension, granted extension/Leave to Remain in the UK under Tier 1(General) until 16th January 2015
