Unmarried non EEA visa so confused

Post by Zobobear » Thu May 15, 2014 8:50 pm

Hi everyone, I hope you can help as I'm so confused

I'm an unmarried no eea partner of an eea national - back story

I originally arrived in the uk on a working holiday visa - I met my partner and overstayed by a few years

We then got legal advice and were told we had no other options of me staying , Unless my british partner applied for a German passport (his parents are German) and we apply the EU route.

We then applied for a FAmily permit and after some time I received my EEA FP issued 09/03/2010 valid till 09/09/2010

I then arrived at Dublin airport 04/08/2010 (flights were cheaper )

Applied for my residence card issued 29/12/2010 valid till 29/12/2015

We have been living together the past 4 years - my partner has been working full time with no gaps only to change jobs etc (I'm assuming this is exercising treaty rights)

I have a few questions

1. Since my partner is already Holds a British passport , since we applied the EU route does he need to still apply for PR then naturalisation in order for me to apply for PR in 2015 -( apologies if this is a stupid question)

2. If not do I still go ahead and apply for PR in 2015 OR do I apply for naturalisation since he already holds a British passport.

(This may not make a difference but whenever we went on holiday he always used his BP)

3. When would the clock have started for me to apply for either PR or naturalisation 09/03/2010 when my FP was issued or 4/8/2010 when I arrived in Dublin

4.does it matter that I arrived in Dublin and not straight to the UK -as Again lights were allot cheaper to dublin and then flying over to Liverpool

I'm so confused and hope you guys can help or advise

Thanks for your help

No he/she does not need to apply for PR

2. If not do I still go ahead and apply for PR in 2015 OR do I apply for naturalisation since he already holds a British passport.
it is your choice although majority would advise to go for PR first and then naturalization

(This may not make a difference but whenever we went on holiday he always used his BP)

3. When would the clock have started for me to apply for either PR or naturalisation 09/03/2010 when my FP was issued or 4/8/2010 when I arrived in Dublin
from the date you arrived with intention to live in UK. some also argue it starts from the issue date of residence card for un-married partners. however, if the relation was confirmed via FP then as i just mentioned. wait for a moderator to confirm this in particular

4.does it matter that I arrived in Dublin and not straight to the UK -as Again lights were allot cheaper to dublin and then flying over to Liverpool
makes no difference.

i would advice to go for PR first to confirm your residence and then apply for BC , providing you meet all other criteria.

Thanks for your help
