Tier 1 General dependent - 5 year route

Post by ozlematak » Sat May 24, 2014 1:39 pm

Hi,
I am dependent of a Tier 1 General visa holder who is eligible to apply for settlement after 20th July 2014.
My visa history is as below:
· I was first granted Tier1(General) on 12.08.2010 (duration = 2 years, expiring on 12.08.2012)
· I married to my husband on 16.06.2011
· I moved in the UK on 12.07.2011 and started living with my husband
· I applied for extension in London on 08.08.2012 together with my husband as his dependent (Leave to remain as PBS Dependent)
. His visa was extended for 2 years but my application was refused on 04.01.2013 on the basis that: “switching to dependent category is not permitted within the country”
. I left the UK on 19.01.2013 and made an application for Tier 1 dependent visa in Turkey
. I was granted “Tier1 (General) Partner” on 30.01.2013 valid until 14.08.2014 and entered in the UK on 09.02.2013
I have continued living in the UK with my husband.

As I was granted dependent visa after 9 July 2012 (legislation changed), we believe eligibility criteria for me to apply for settlement(ILR) is 5 years.
We are planning to get a premium service appointment for a date after 20.07.2014 before 14.08.2014.
My husband will apply for settlement and I will apply for an extension of stay as PBS dependent with the form on this link https://www.gov.uk/government/publicati ... -dependant
Is it advisable for me to apply the same day as my husband (both in person)? Do we need one appointment or two consecutive ones?

Can I count the period I lived in the UK with my Tier 1 General visa(from 12.07.2011 to 19.01.2013) towards ILR 5 year qualification? Or do I need to wait until July 2018 to apply for ILR?
Thanks
Ozlem

When your dependent visa granted that time do you have valid tier 1 visa ? . I mean do you have continuous visa validity or it was broken ?. If it was broken then you need wait 5 years i.e 2018 .

I applied to switch to dependent visa in the UK (08.08.2012), before tier 1 visa expired.Since switching to dependent category is not permitted in the UK,I got refusal later after 5 months,so I left the UK in 28 days (19.01.2013).Then I got the dependent visa by applying from my home country in 30.01.2013.And returned to the UK on 09.02.2013 .
Does this mean it is broken or not?

When I applied for dependent visa in UK at 8/8/2012 , I had Tier 1 General visa which was expiring on 14/08/2012.

your qualifying period was resetted, So you need wait another 5 years from 09.02.2013 date to apply for ILR.

Thank you for your reply.
But do you mind telling me the policy(document and section of the document) that helped you to come up with this result?
Thanks
