Tier-2 General: RLMT Advertised Salary vs CoS Salary

Hi All,

This is for Tier-2 General Visa - Fresh apply - outside UK.
Does the gross salary entered in CoS should be in the RLMT advertised salary range? Details below. Is this pose a threat to Visa approval?

RLMT Advertised Salary Range = 40,000 GBP to 50,000 GBP
But in CoS, Gross Salary in pound sterling including any allowances and guaranteed bonuses : 38500 GBP

Appreciate help on this.

That's completely wrong.

The salary in COS should be within the range as specified in Advertisement. This would have been valid only if your company had posted with salary "Competitive".

Let know your company and ask them to re-do RLMT or issue you new COS with salary within that range otherwise your visa will be refused.

Hi Muhdkhokar,

Thanks for the info. Yes I can see the sentence in the RLMT Advertisement as "a competitive Salary" and they have mentioned the salary range as well.
Is this written in any Tier-2 General Policy guidelines? Please advise.

One more query. Can the relocation support amount can be taken as allowances and can be added to Gross Salary.? In that case, i will be in the Salary range as advertised in RLMT. Then i can ask my employer to add the Gross Salary change in the CoS using ' Add Sponsor Note' section.

Is that fine? Please help. Thanks.

Is it ok to specify the salary as competitive for the job advert for RLMT? My companies lawyer says below:

an indication of the salary package or salary range or terms on offer (we strongly advise to use ‘competitive’ as the
indication of the salary on offer. Please note no other wording, such as ‘meets the national minimum wage’,
‘depending on experience’, etc. will be accepted by the Home Office);

Any idea please?

Say,
RLMT Advertisement Salary range : £25,000 to £27,500
CoS application Salary : £32,000
Will this cause any issues in T2 General Visa application?

Hello Arun,

Were you successful in your Tier 2 application when your salary was less than that quoted in teh Advertisement?

I am in a similar situation. The advertisement has been posted for 55000-60000 GBP but my salary is 45000 GBP. Will there be any issues in my Tier 2? My salary is above the Tier-2 minimum salary for the job code.

Can the senior members share their thoughts here please. Really appreciate it.

I don't think so. If the advertised salary is higher, there might be local residents willing to apply for this job, and the company will not "have to" hire an oversea employee. Or in order words, the resident labour market test is not passed.
