DLR extension, issued June 2011?

Hi all

My story

Overstayer with partner arrived 2005
Applied under article 8 August 2008 based on strong family ties
Refused Feb 2010
Appeal refused April 2010 and ordered to sign in every week at local police base.
Detained, yes detained September 2010 with deportation order to remove my partner and kid too
Found slick lawyer who submitted fresh claim based on our child's circumstances,( Health & other reasons)
Released From detention centre after 72 hrs and told to wait.
Refusal again! March 2011 ( refusal letter had google search references, including my countries Bio, animals, schools, population, tourist hotspots ,weather etc etc, i swear this case worker was high as a kite, totally irrelevant to our case :)
Appeal heard at Tribunal, 1st tier, Judge ripped Home office PO to shreds and informed them they were wasting tax payers money on lazy research and case presentation . Told us he would allow the appeal, lasted less than 15 mins in there.
HO were so pissed off, took 4 months to return the endorsements, involved local MP, their argument was that they were short staffed.
and now it begins again :)

1)My question is, DLR extension form, does it have a fee?

2)Our kid will be 9yrs old this month, can we submit a separate form for citizenship on his behalf as he will be 10 yrs in the country since birth in just about 7 months after our Dlr extension deadline?

FLR(O) for a DLR extension. Children should be able to apply for SET(O) after 3 years DLR.

Thnx for response. Its extension for DLR, we were granted 3 yrs limited leave to remain in 2011.

Yes, adults need 6 years DLR but I'm sure there was a case where children (in their best interest) should be settled after 3 years DLR. If Vinny comes along, I'm sure he'll find the case.

For Form T registration as British, immigration status is irrelevant.

7 year child concession rule?

Hi all

Hoping someone can clarify this, Long story short, My family and i were granted Dlr 3 yrs and is due for renewal in about 10 weeks time My child is turning 9 yrs next month and was wondering if its worth applying for naturalisation looking at the timeline from her birthday and our dlr renewal will be about 2 months into her 9th birthday. 10 months shy of her 10th birthday. Not sure how long the HO take in dealing with naturalisation applications based on the 7 year rule.

hope i am making sense, if not please do ask me to clarify :)

She was born in the UK.

As far as I know, the 7 years rule for children have nothing to do with naturalisation or registration. So, it's probably difficult.

Best to wait until she is 10 or after a parent is granted ILR.

Hi again

Can someone please explain the 28 day rule please, Do they mean submit ur application anytime as long as its within 28 days of leave expiring or it has to be bang on 28 days and not a day earlier or late? My DLR is due to expire soon and just sorting the funds, £3k + is what i have to pay the HO in fee's.I am just trying to avoid a situation were they will say we overstayed our leave.

From 28 days before until the day before expiry.

The case for children settling after 3 years is SM and TM and JD and Others v SSHD [2013] EWHC 1144 (Admin).
