180 DAY RULE

Post by scorpio_besal » Sat Jun 14, 2014 8:49 pm

Hello,

I've been browsing through the ukba page regarding tithe settlement application for T1 general and on the page it says:

During the continuous residence period, you cannot be outside the UK for more than 180 days in any 12 consecutive months.

I interpreted very simply:
As long as you don't spent 180 days outside of the UK in a continuous period of 365 days, you should be fine.

So if you go:
Year 1: 30 days in summer, 65 days in winter.
Year 2: 80 days in spring, 60 days in autumn.
Year 3: 50 days in spring, 80 days in autumn.
Year 4: 60 days in summer, 20 days in winter.
Year 5: 70 days in spring, 60 days in autumn.

You are still ok.

But, on some other forums, people have been talking about it like it's 180 days in a 5 years length of time, which confuses me a lot.

Just wanna be sure how should the rule be interpreted?

Thanks

Your interpretation is correct.

Read, "calculating continuous period" in the ukvi site.
