Urgent help please

Post by RANA-ALI » Mon Jun 16, 2014 5:24 pm

Hi there,
Can i please request inputs from any one which could help me
Went ro sheffield peo today to apply for my dependant set m
Which didnt go well
I ll tell u the history of her visa first
Came in uk 2009 student dep
Then spent 2 year on psw dep
After i got ilr under long residence
Her flrm approved in march for 2 years (under old rules )
Went today after all senior members advic and reasearch as well,
But after painful wait case work ask us come to counter and told us that there some issues with the application , so the main reson that it cant be approved that she has to wait 5 years even tho her brp clearly says 2 years leave
In short i had print out of immigration rule 287, 319aa , email correspondence where they says that previous leave an be combined , case worker guide line for combining leave of pbs and flrm to satisfied 2 year time bfore applying set m
After all discussion her manager came and said"the manager "who deal with complex case is not here , and will be in tomorrow , we can keep all ur documents and will upate u tomorow
Now im so stressed and panicing , dont knoe what to do
Please any one kind enough to advise me and get me out of misery. What should i say tomorrow on phone now? Is there any thing i should mention again
Thanks a lot , u all been really helpful before and i would be really really grateful for ur feedback
Regards
Ali

What you have been told is correct, I would assume that the 'complex case' manager will be aware of 287(a)(i)(d) and that s(he) will apply it accordingly.

State that leave was granted under Part 8 of the immigration rules and that 287(a)(i)(d) has not been amended thus, time as a PBS dep can be amalgamated with that of FLR(M) to equate 2 years and thus, you spouse is now entitled to settle. If s(he) say anything, say you'll take this matter to Judicial Review.

What could be other option than going JR , i suppose its quite expencive route ,
Also do u think i have mention the right rules or am i missing any thing
Btw i left with them a copy of email reply from family settlement
Copy of 287
Copy of reply for mr hasan query from what they know website.
Case worker guidance about combining previous pbs leave
Copy of 319aa defining the meaning of relevant point base migrant
Is there any thing else to mention tomorrow apart from what u just replied above
Again im so thankful for ur reply

Yes, so long as your spouse states she'd like you to speak to them, there shouldn't be an issue with you talking to them.
