ILR - Qualifying period and Application date

Post by carramesh » Mon Jun 23, 2014 9:54 am

Could you please let me know, What would be qualifying period and the earliest date, I can apply for ILR.

Details:

Entry clearance date: 02/09/2009
First entry to UK: 28/10/2009 (arrived to UK after 57 days of entry clearance)
Current Leave to remain expires on 10/01/2015.

Question -1: what periods they considers for qualifying periods of 5 years.
(i) - Do they consider from 02/09/2009 to 02/09/2014 (5 years) OR
(ii) - Do they consider from 28/10/2009 to 28/10/2014 (5 years)

Question - 2: If they consider the 1-(i) / (ii) can I apply before 28 days of qualifying period i.e. 02/09/2019 or 28/10/2009.
If yes - what would be the earliest date I can apply for in both the cases ?

Many thanks for your responses....

Hi, I two questions, one of which is similar question to the question already posted here - I'd be really grateful if somebody could answer:

Details:
Entry clearance date: 13/04/2010
First entry to UK: 17/06/2010 (arrived to UK after 66 days of entry clearance)
Current Leave to remain expires on 13/04/2015

QUESTION 1: What period is considered for qualifying periods of 5 years.
(i) from 13/04/2010 to 13/04/2015 (5 years) OR
(ii) from 17/06/2010 to 17/06/2010 (5 years)

It's it's (i), does this mean I can apply for my ILR 28 days before 13/04/2015?

QUESTION 2: When can I calculate my continuous period in the UK? Does it start from 17 June 2010 or 13 April 2010? If it's 17 June 2010 then that doesn't give me the full qualifying continuous period.

If it's 13 April 2010, then if I apply 28 before my leave expires, it means I wasn't in the UK at the time when the qualifying period begins. Confused!!

Many thanks for your responses and help!

Hi Ess2013

i got a query to ask you and sorry to use your thread, but i have read one of your previous requests where you have used an account manager statement for Tier 1 and the first 4 digits were like **** and currently i am in the same situation. So just want to ask were those statements acceptable.

Thanks

CHILD BENEFIT - one Parent is in ILR and other in Tier-1 Dep

Post by carramesh » Tue Jan 06, 2015 5:09 pm

child benefit...
Hi Guys,
I got my ILR recently and I applied for PBS Dependant visa for my wife (Her VISA definitely shows NO RECOURSE TO PUBLIC FUNDS)
we have a child who is born in the UK.

My question is:
1. Can I claim Child Benefit for my child. (as a father responsible for child)
2. Does it has any impact on my wife ILR in the future. (Now she hold Tier-1 (Gen) dependent visa and she will get PBS dependent Leave to remain visa)

Your feedback will help me and many...

Thanks...
