Tier 2 ICT to General & cooling period

Hi Guys,

I am in currently in UK under Tier 2 ICT long term since sept' 2011. I will complete my 5 years in Aug 2016 after which I will need to serve one year cooling off period out of country.

My employer is ready to sponsor me in Tier 1 General intead of ICT next year march when my visa is due for renewal, which I can apply from my home country.

My query is, since I would not be completing 5 years on the application date, will I still need to serve 1 year cooling period OR since I would have only complete 3.5 years approx at time of application, this rule doesn't apply in my case.

Please help & thank you for your time and kind help.
