Notice of Intended prosecution

Hi Guys,

I have received a notice of intended prosecution by police just before I was about to submit my application form (AN). The letter says that the driver of the car can be eligible for awareness course if he matches a certain criteria given overleaf. I have checked and I should be eligible for that course as my speed was within the bracket and I have not attended any awareness course before. Neither I have received any FPN during my stay in UK.
I have not replied to Police yet as I have another 15 days to reply them that I was the driver of the car.

Now my question is should I go ahead and submit my application and also reply to police in parallel OR do I need to reply to police and wait for their response and then submit my application? Also do I need to mention anything on my application if I am not given any penalty points?
