apply for tier 4 visa after tier 1 refusal

Hi,
i got refusal tier 1 enterpreneur on 09/05/2014, i went for the appeal but i am not confident abt appeal , can i apply for tier 4 student visa,

wait for appeal outcome then u can reapply to student visa as well, if u like.
