appeal & pregnant

Post by lennisha » Mon Jul 14, 2014 11:42 pm

Hi all,

My situation is a bit complex due to the lack of immigration knowledge however the situation is as follows
I cam to the UK in august of 2011 on a visitors visa, I then applied to extend at the end of my six months using a FLR (P) form with was an incorrect application however I was granted a 6 more th visa up until my 18th birthday.
I only done it this way because my brothers daughter came to the UK on a visit visa and was granted a visa so we were not aware the situation will be different I was a dependant of my brother.

I then sent a new application SET (F) as stated by a home office official when we rang them, a year later that was refused.

We appealed against the decision based on the fact that I was in a relationship with a British man, as stated by my solicitor this would be the correct option, however the appeal was refused, now I have appealed to the upper tribunal which is in progress, my partner and I have split up and I am 28 weeks pregnant, if my appeal is refused and I return to my home country what are my options for coming back to the UK?

being this far gone in your pregnancy they won't be able to force you to fly back home I don't believe.

You'll need a doctor letter to confirm this. If the dad is British apparently there's a few ways to extend your leave.

I am aware of derivative rights but there may also be other ways as well. https://www.gov.uk/derivative-right-res ... ligibility

confirm it with a more knowledgeable person.

Hey thanks for the reply, the problem is the baby isn't born yet so I wouldn't qualify for a derivative card.

I meant after the baby is born. There's other routes as well.

Get a letter from your gp confirming you are unable to travel at this point in your pregnancy. I'm pregnant as well and my gp issued me a letter.

At 28 weeks airlines do not accept you without confirmation from your gp anyway.

If I get the letter from my GO stating I am unable to fly, what would my status be then? Would I be considered illegal?

And would the GP issue the letter even though I have no pregnancy issues to date?

I have a friend who is pregnant and received a 6 month discretionary leave after her gp wrote a letter. So in this time if you're currently legal you will remain so with the same previous rights. What you need to plan is after the baby is born.
Flr(fp) application.

Applied - 29/07-14
HO Received - 31/07/14
Biometrics done - 12/08/14
Decision - Granted - 10/10/2014

you are scaring yourself for no reason.

Your status will remain the same. Get a letter from your gp and forward it on.

You do not need complicated pregnancy for non travel. At your stage of pregnancy that makes it complicated enough.

Ask your gp for a letter to confirm that you are unable to travel.long haul flights in your condition.

You're probably going to have to explain to your GP, otherwise they will wonder why you're requesting a letter stating you are unable to travel rather the normal request for a letter stating you are fit to travel. Hopefully he'll be sympathetic.

I didn't explain anything to my gp. He did ask but I didn't tell him.

He assume I wanted to cancel a reservation, I said no I need it for an application.
But anything you discuss with your gp is confidential.
