My questions are what is this biometric residence we have to apply for and how do we pay for it? If applying in person at PEO, biometrics are part of the process on the day, no extra charge. If applying by post, you will get a letter from HO to enrol for biometrics at the Post Office and there is a charge for this (£19 I think).
My second question is we have a baby boy who is 13 months but he doesn't have passport as we have not needed it as we have haven't travelled abroad but I am British citizen so he is also automatically british citizen? Will this be a issue if he doesn't have British passport If you were British at the time of child's birth, the child is British. It is not mandatory to have a British Passport so this will have no effect on your wife's application.
Question three we haven't registered our marriage in the UK just didn't find the time to getting round to it but we have all the certificates and registration from our marriage in Pakistan is that sufficient? If your wife applied for the spouse visa with the marriage documents from Pakistan, these should be accepted for ILR and you should submit exactly the same documents (translated if necessary) for ILR.
And the last question both me and my wife are working I am doing full to time and wife is doing part time 16-20 hours per week do we both have to submit our bank statements if so for how many months 3 or 6 Form and guidance notes in link below, self explanatory, but as your wife is on the pre July 2012 spouse visa, the £18,600pa financial requirement is not relevant, only being able to maintain and accommodate yourselves. You will need to provide 2 years cohabitation documentation in either joint names or individually named.
