Employer Sponsorship Suspension Queries

Hi All,

I have following queries which seems to be puzzling ; (this is for my friend who is quite tensed at the moment).

1. Is there any kind of list from UKBA of Employers whose sponsorship has been suspended momentarily for further investigation ?
2. Can a Employer provide a letter to support his ILR application even though the Employers sponsorship is currently suspended. Will the suspension affect the ILR application ?
3. If for some reason the employer license is revoked can the employee continue working with the employer say for further 30 days until he finds some other good Employer who can sponsor him for work ?

no, once the licence is revoked the former sponsor cannot employ migrant workers. Your friend's leave will be curtailed to 60 days and during this period he can stay in the UK and look for another sponsor,

Just to add to what manci has said, I think you can check the register of sponsors and see if a sponsor is B rated:

B rating is a temporary rating given while an employer is being investigated. I'm pretty sure it allows them to continue sponsoring existing workers, but stops any new CoS allocation. I'm not sure but I think they re-rate if they find that a sponsor has breached one or more of its sponsor duties and they are not satisfied that something has been done to correct it. They then issue an action plan and tell the sponsor what it must do to have A rating restored.

I imagine they can, but I'm not sure how often they simply revoke a licence without re-rating the sponsor first.

Check the register and if your sponsor is B rated, then there is still a chance to rectify it if they agree to an action plan and fulfil its terms.

on the 5 year route a letter from the employer is required about continuing the employment in question and this couldn't be provided if the sponsor's licence had been revoked

Thank you Manci, but here the licence is not revoked just suspended. Interestingly a person who has been issued a certificate of sponsorship can start to work with the employer who's licence has been suspended.
