ILR eligibility - work permit & Tier 2 - ICT post Apr 2010

Post by SAP_SAN_2010 » Wed Aug 20, 2014 3:09 pm

I had the UK work permit issued in Jan 2006 for a period of 5 years (10th Jan 2006 to 9th Jan 2011). I work for a Global company, and was working in different location in India, US, Germany & Netherlands during this interval.
On UK work permit I was in UK for small durations.
1. Jan 2006 to July 2006
2. Aug 2008 to Oct 2008
3. April 2009 to June 2009
4. 15th Dec 2009 to 31st Jan 2010
On 3rd August 2010, I moved to UK permanently along with my family. As I was moving with my family I was advised by my company to get a fresh visa (ICT) from India , so that we can all be on the same visa. I wasn’t aware of the April 2010 rule change. That with the new ICT visa I won’t be eligible for ILR.
However at the time I was issued this new ICT Visa, my previous work permit was still valid.
Can you advise on my eligibility for ILR after completion of continuous stay in UK in July 2015.
Regards,
San

From January 2010, did you have leave to remain as a Work Permit holder until you were issued with your new visa in August 2010?

If you did, when did it expire.

On the face of things, it seems to me, that you do not qualify, unless it could be shown , that your had a valid visa, between January - August 2010.

To add to Obie comments: Please be aware that if you are outside UK for more than 180 days at a stretch then your continuous residence is broken.

That's not technically true for PBS applications, rather absences should not exceed 180 days for each 12 month period.
