Visa Category for Dependent when I am apply for ILR

Hi,

I am on a Tier 1 General Visa:

Date of Issue: 09 / Nov / 2009
Data of first entry in UK: 06/ Feb / 2010 (Within 90 days of issuance)

I would be applying for ILR after 13 October 2014 as I am eligible for the same.

I got married on 08th December 2012 and my wife came here to UK on 14th Jan 2013 as a Tier 1 General dependent.

I am not too sure, which Visa category would apply to her - Can we apply for her as an ILR Dependent together with my application? or do I need to get her an extension as a Tier 1 Dependent. I am not very sure on this one.

Can someone help me here.

Your wife will be eligible for ILR through 5 year route. You cannot include her on your ILR application as a dependant as she is not eligible yet. You can apply to extend her visa as PBS dependant until she has accumulated 5 years of residence.
