Confused, when to apply for ILR

Hi,

I am confused as to when am I eligible to apply for ILR.
My situation is like this:

I came into UK on a Dependant Visa then later planned to switch to a WP. My employer was ready to apply for a WP for me. He applied for a an in-country WP in Jun 2004 got the WP approval in Aug 2004.

Then I applied for FLR, my Passport was returned to me in Dec 2004.
So the FLR stamping on my Passport is from Dec 2004.

Based on the above when would I be eligible for applying for ILR?
is it 5 years from Aug 2004 or Dec 2004.

Please advice.

I am in a similar situation with my work permit issued on 7 November 2002 and the FLR issued in-country on 16 December 2002. I have been told by this forum and the home office that the 5 years are calculated from the date of the FLR and not the work permit issue.

My current leave to remain expires on 31 October 2002 and my employer will have to apply for a work permit extension, an FLR and I then have to apply for the ILR. All this for a matter of 19 days as I qualify for ILR on 19 November 2007! Crafty money making tactics from the HO!

I am also in a similar situation - even called HO and they told me that if it was in country application and I had FLR when my WP was issued you can apply by the date your WP issued as you have been granted permission to work and started working earlier than your FLR extended. However some people say that in my case I should apply for ILR by FLR date. What happens if I go to the HO, pay the fee and say I have been told by your adviser that I can apply earlier than 5 years since FLR date? Will they ask me to come later?
It is mentioned in the I. Rules that "spent 5 years in the category". What is the date when your status changes taking into the account that one already has leave to Remain (I was on a student visa and the new stamp I have got was 100% similar as the previous student one).

Hi All,

I am in a similar situation as you all, my workpermit was approved on 12th Nov 2002 and received the LTR on 08th Jan 2003, I was on student visa when the workpermit was approved, I was working for the company before the workpermit was approved as I was on student visa (Course completed Sept 2002, Graduation 28th Nov 2002). It would be really good to know if someone has a definitive answer.

Its all very confusing but I think the home office will only consider the FLR date while counting the 5 year period for ILR.

Hi John / olisun / and other senior members,

Can we conclude that the clock starts from the date the FLR was stamped on the passport even in the case of an in-country WP?

Any other members who have had an in-country WP and a successful ILR later, can you please share your experience.

Back in 2004 the FLR rules were different, and the issuing of the work permit gave permission to work from that date (as detailed ont he permit itself). As a consequence, I believe that the date of issue of the work permit can be taken as the date from which the 5 years begins.

This is different from those who applied later and who could not work until they had their FLR in.
