quck question

Post by magicman316 » Mon Oct 13, 2014 4:54 pm

Hi there,

My wife came to the UK in August this year on a UK Spouse visa.

Is she allowed to travel with me to mainland Europe or Dubai on this visa or would she need to get visa for those countries as she is a Pakistani national still?

Also how long is she allowed to spend out of the UK, i.e. trips back to Pakistan or other holidays without affecting her further leave to remain/ILR process which will begin in next few years?

Many Thanks.

13/06/14 - Email & Call from VAC to collect Passport
16/06/14 - Visa Granted!

She'll need visas as she always has.

If you are a british citizen then, in theory, she can travel with you to Europe visa free - as your right of free movement (providing we are still in the EU ;-)) extends to her when you are with her. HOWEVER, this is frequently not recognised by airlines and border guards. Thankfully getting a schengen visa is free and easy for the spouse of an EU citizen.

Thanks,

Are there any rules about how long she can leave the UK for? or how many days she needs to have lived in the UK to apply for the next stage, i.e ILR or Further leave to remain?

Thanks,

2,5 years residence before applying for her first extension on form FLR(M). This will give her a further 2.5 years after which she can apply for ILR. i.e 5 years in total.
