All,

It seems Home Office have today published a statement of changes to the rules. Amongst these is confirmation that the requirement that a Tier 2 (General) migrant cannot have spent more than 6 years in any Tier 2 visa category was an error.

• It is not possible for applicants to switch from the Tier 2 (Intra-Company Transfer) category to other Tier 2 categories within the UK, unless they entered under the Tier 2 (Intra-Company Transfer) rules in place before 6 April 2011. A drafting error meant that the time spent in Tier 2 (Intra-Company Transfer) counted towards the maximum period of 6 years that applicants may spend in other Tier 2 categories. This is being corrected.

This is indeed good news and will warrant a "sticky".

It also means that many whose initial leave was T2 ICT Established Staff and later switched to T2G may now be eligible for ILR which they were not under the April 2014 rules.
