Query on ILR validity

Hi,

This is w.r.t a friend of Mine

He has got his ILR in 2007 and there were no Bio-metric cards then.He left UK in 2009 and came back for a month in 2010.

He has not travelled to UK since 2010. Would his ILR status be still valid ?

An advice is very much appreciated.

No (18(ii) fails), unless paragraph 19 or 19A applies.

He could try applying for a Returning Resident visa.

Or he may ask a kind Immigration Officer to admit him under paragraph 19 or 19A.

However, note that a member had problems transferring his ILR onto a new passport because he was two days over the two years limit when he was previously admitted.
