What is the earliest time to apply for ILR!

Post by ashehzi » Thu Dec 11, 2014 11:20 am

Hi Everyone,

I have a following case to discuss:

My initial Tier 1 (General) entry clearance was granted on 01-Jun-2010. I didn't come to UK within 90 days of entry clearance and I entered UK on 10-Oct-2010. Since then, I have got two extensions with current extension expiring on 23-May-2017. I haven't been outside UK except once and that too for less than a month, meaning I am within the limits of 180 days of stay outside UK for any of the five consecutive years.

Going by above, I am eligible for ILR on 10-Oct-2015. Does that mean

1. I can only apply for ILR on or after 10-Oct-2015 OR
2. I can apply for ILR within 28 days before 10-Oct-2015, meaning any day after 12-Sep-2015?

Any answer with reference to some clear documentation would help.

Many thanks.

Thanks.

Does this include even applying via Premium Service or only to postal/courier applications?

I think so. However, as you have got plenty of leave, then there is no need to hurry.

Found on Page 4 of

https://www.gov.uk/government/uploads/s ... _11-14.pdf

it says:

"Please do not apply more than 28 days before completing the qualifying period. If you apply earlier than that, your application may be refused. If that happens, we will not refund the fee and you will have to pay again when reapplying"
