Tier 2 Refusal; Wrong Category

Post by tier2_refused » Mon Dec 15, 2014 12:53 pm

Hi.

I have received a refusal of visa today because of a very silly mistake in COS. The COS was assigned in
Tier 2 -> High earner category rather than tier 2 -> general category.

Can some one please suggest me if I can appeal and show any proof( from that company )that
it was a mistake while assigning COS ?

Thanks.

I believe that you might be able to appeal this decision.
Who made the application? yourself, solicitor/lawyer or employer?
Did the home office make contact in relation to this? Did you meet all the other requirements for T2G?

I made it myself and the issue was in COS not in application form
They didn't contacted either with me nor with sponsor.
Yes everything is fine.

They have allowed me administrative review, not full appeal

Waste of time appealing for two resons.
High earner COS does not need a RLMT nor is it subject to the restricted COS panel.
As you are an overseas applicant you need a Restricted COS to be awarded after a RLMT plus the Sponsor has to apply for the RCOS from the monthly panel.
Once a COS is used for an application it can not be replaced. A new RCOS is required in your case.
