hi

I made a tier 1 application in december 2012. I varied the application to a tier 2 in may 2014.

my employer waited for 7 months but no decision came and now wishes to withdraw the sponsorship in first week of jan.

my question is i have found a new tier 2 sponsor. Can I do same day priority service. does it have to be before my current employer withdraws the certificate of sponsorship or can it be after 10th January too (day my current sponsor withdraws the job offer).

You applied for Tier 1 in Dec 2012 and you didn't get a decision by May 2014?

A Tier 2 application should be processed within 8 weeks from the date of you applied or varied the application and a CoS is only valid for 3 months.

Hi

Yes no decision was given until May 2014 for my Tier 1. My new sponsor is a small company.

Now my sponsor has withdrawn the sponsorship and I need to know the process after this. My previous leave has expired and therefore, I am not sure if I will be given 60 days curtailment of leave.

It will a simple refusal of leave that you will receive due to the sponsorship being withdrawn. So you will get 28 day grace period to put in another application or leave the UK.
The refusal will come with a right of appeal, so if you appeal and start looking for a new sponsor you will get more time to play with.
